ABDUL HADI MARBLES MINES VS The SECRETARY, MINES AND MINERAL DEPARTMENT, GOVERNMENT OF BAOCHISTAN, CIVIL SECRETARIAT, QUETTA Decision of matter by the officer after his transfer---Effect---Petitioner was aggrieved of the order passed by appellate authority remanding the matter to Mines Committee for assigning mining rights to petitioner after deduction of area of respondent from the area of petitioner--- Validity--- Appellate Authority (Officer) after his transfer heard the case and decided the same, whereas he should not have heard it because of his transfer having been ordered 'with immediate effect'--- Order passed by appellate authority was set aside and matter was remanded for decision of appeal afresh--- Constitutional petition was allowed accordingly.
