KHAISTA MUHAMMAD VS State Ss. 302(b) & 109---Khyber Pakhtunkhwa Arms Act (XXIII of 2013), S. 15---Qatl-i-amd, abetment, possessing unlicensed weapon---Appreciation of evidence---Recovery of weapon of offence on the pointation of accused---Reliance---Scope---Accused was charged for committing murder of his daughter/complainant by firing---Evidence of recovery of pistol on pointation of the accused could not be disbelieved for the mere reason that the witness while recording his statement had given certain concessional statement in favour of the accused---Other evidence was also available in support thereof in the shape of statements of Police Constable and the Investigating Officer, who had stood consistent in respect of recovery of weapon of offence on pointation of the accused---Circumstances established that the prosecution had proved its case against the accused, however due to some compelling circumstances, death sentence was reduced to life imprisonment---Appeal was partially allowed.
