NOOR MUHAMMAD KHAN VS State Ss. 302, 324 & 34---Qatl-i-amd, attempt to commit qatl-i-amd, common intention---Appreciation of evidence---Appeal against acquittal---Motive was not proved---Scope---Accused were charged for committing murder of the grandson of complainant by firing---Motive was stated to be an early exchange of firing between the parties which was allegedly compromised---Investigating Officer did not collect anything to explain that who out of the sides was involved in the said episode and that what role the deceased played therein,as the deceased was hardly eighteen years of age---Even the complainant did not produce independent witnesses in that respect, more particularly,the people who patched up the matter between them---Circumstances established that the prosecution failed to establish its case beyond doubt--- Appeal against acquittal was dismissed, in circumstances.
