NOOR MUHAMMAD KHAN VS State Ss. 302, 324 & 34--- Qatl-i-amd, attempt to commit qatl-i-amd, common intention--- Appreciation of evidence---Appeal against acquittal---Delay in sending the empties for analysis---Scope---Accused were charged for committing murder of the grandson of complainant by firing---Collected empties were received to the Forensic Science Laboratory, after a considerable delay, but the Investigating Officer did not mention that where those empties were lying in the intervening period---Neither the Moharrir of the concerned police station was examined nor the Police Official who took the same to the laboratory---Investigating Officer could not prove that the empties were lying in safe custody---In such eventuality, the prosecution could not establish the safe custody of the collected empties and its onward dispatch to the Forensic Science Laboratory, as such, that piece of evidence could not be taken into consideration, that too, for awarding capital punishment---Circumstances established that the prosecution failed to establish its case beyond doubt---Appeal against acquittal was dismissed, in circumstances.
