AFSAR ALI VS MAJID KHAN Ss. 302(b), 324 & 34---Qatl-i-amd, attempt to commit qatl-i-amd, common intention---Appreciation of evidence----Vicarious liabilities---Scope---Accused were charged for the killing of brother of the complainant and ineffective firing at him as well as witness---Record showed that there was a single entry wound on the person of the deceased for which two persons were charged and there was no definite opinion as to whose shot proved fatal but that doubt was not sufficient for acquittal of the accused---Bare reading of S. 34, P.P.C. revealed that when a criminal act was done by several persons in furtherance of common intention of all, each of such person was liable for that act in the same manner as if it was done by him alone---Appeal against conviction was dismissed, in circumstances.
