AZMAT ULLAH VS GOVERNMENT OF KHYBER PAKHTUNKHWA through Secretary Forestry, Environment and Wildlife, Peshawar R.10---appointment by initial recruitment---Retired employees' son quota---Scope---Petitioner sought appointment on the basis of retired employees' son quota---Contention of department was that the petitioner's father, for having been retired from service in Basic Pay Scale 5, did not fall under the definition of Class-IV employee---Validity---Perusal of R.10 of the Khyber Pakhtunkhwa Civil Servants (appointment, Promotion and Transfer) Rules, 1989, revealed that employees up-to BPS-5 were the Class-IV members of an establishment---Petitioner's father was awarded personal up-gradation in BPS-5 which after his retirement automatically reverted back to BPS-3 with the same set of duties---Constitutional petition was accepted and the department was directed to enlist the name of petitioner in the list so maintained for the purpose.
