BASHIR AHMAD VS GOVERNMENT OF KHYBER PAKHTUNKHWA Promotion---Out of turn promotion---Withdrawal of---Scope---Out of turn promotion of petitioner was withdrawn against which he filed departmental appeal but same was dismissed---Validity---Petitioner had been promoted out of turn at the cost of the career of his senior employees---Employee had failed to justify his out of turn promotion in preference to his senior employees---Petitioner was not fair and impartial in his claim and he had not come to the Court with clean hands---Out of turn promotion of petitioner was not only against the Constitution but also against the Injunctions of Islam---Performing duties on acting charge could not justify the claim of petitioner for his promotion in preference to his senior employees---Impugned order of promotion was rightly withdrawn by the department---Senior employees of the department were entitled to be considered for promotion prior to the petitioner---Constitutional petition was dismissed, accordingly.
