HAIDER ALI VS The MANAGING DIRECTOR, BANK OF KHYBER Rr. 14.3, 14.6 & 14.7---Employees of Bank of Khyber---Allegation of misconduct---Dismissal from service---Contention of employees was that no regular inquiry had been conducted and they had been condemned unheard---Validity---Neither any show cause notice had been given to the employees nor any reason had been recorded in writing to dispense with the inquiry---Mandatory provisions of R. 14.7 of Bank of Khyber Employees Service Rules, 2012, had not been complied with while issuing impugned orders---Competent authority was bound to inform the employees by an order in writing of the grounds for proceedings---Employees should have been afforded an opportunity of personal hearing before passing order of penalty---Impugned orders suffered from inherent illegalities and irregularities and were not sustainable in the eyes of law, which were set aside and authorities were directed to re-instate the employees in service---Employees would not be entitled for any back benefits as during the period of their dismissal they had not served the Bank---Bank might proceed against the employees in accordance with the mandate of R.14.7 of Bank of Khyber Employees Service Rules, 2012---Constitutional petition was allowed, accordingly.
