AYESHA BATOOL VS GOVERNMENT OF KHYBER PAKHTUNKHWA, through Secretary, Higher Education Department, Peshawar Employees having Master Degree in their respective discipline at the time of their appointments---Up-gradation of post---Government upgraded the posts of employees with immediate effect---Contention of employees was that authorities had not considered their cases for up-gradation in BPS-17 from the date of acquiring Master Degree like other similarly placed employees---Validity---Earlier constitutional petitions in the similar cases had been allowed and authorities had been directed to grant up-gradation from BPS-16 to BPS-17 from the date of respective appointments to the employees having qualification of Master Degree in their respective discipline---Employees were performing their duties since the date of their appointments and there was no objection on their eligibility---High Court observed that authorities shold have followed the formalities required prior to processing the appointments and employees could not be blaned for any lapses on the part of appointing authority---Authorities were directed to grant up-gradtion to the empoyees from BPS-16 to BPS-17 from the date of their appointments---Constitutional petitions were allowed, accordingly.
