ANWAR SHAHEEN VS State S. 497(2)---Penal Code (XLV of 1860), Ss. 302, 324 & 34---Khyber Pakhtunkhwa Arms Act (XXIII of 2013), S. 15---Qatl-i-amd, attempt to commit qatl-i-amd, common intention, unlicensed possession of arms---Bail, grant of---Further inquiry---During the incident the deceased and the injured complainant each received only one firearm injury---Present case was registered against four persons, out of whom one co-accused with similar allegations to that of present accused and co-accused had been found innocent during. the course of investigation and his name was placed in column No.2 of the report under S. 173, Cr.P.C.---During the course of investigation nothing was recovered at the instance of or from the possession of present accused and co-accused---Furthermore one of the co-accused got recovered a pistol and two out of eight empties secured from the spot matched with that pistol---All such circumstances made the case of present accused and co-accused one of further inquiry falling within the ambit of S. 497(2), Cr.P.C.---Resultantly both of them were admitted to post-arrest bail---Petition for leave to appeal was converted into appeal and allowed accordingly.
