AMJID KHAN VS State S. 173(1), proviso---Investigation report (challan)---Delay in the submission of investigation reports (challans) before Trial Court---Plea of prosecution that compliance with S. 173(1), Cr.P.C. was made if the investigation report (challan) was submitted to the Public Prosecutor---Held, that such interpretation of S. 173, Cr.P.C. was not correct; its language was clear and required that the report was to be submitted through the Public Prosecutor but its destination was the Magistrate/Court.
