STATE through A.G. Khyber Pakhtunkhwa, Peshawar VS HAKIM ZADA S. 302(b)---Constitution of Pakistan, Art. 185(3)---Qatl-i-amd---Petition for leave to appeal challenging acquittal---Accused was charged for murdering his wife---Trial Court convicted the accused under S. 302(b), P.P.C. and sentenced him to imprisonment for life, however on appeal the High Court, considering the death as a suicide, set-aside the conviction and sentence of accused---Contention on behalf of prosecution that autopsy report conclusively ruled out possibility of suicide as the medical officer noted a complete scar, without obliquity, around the neck, unambiguously suggesting manual constriction of the neck with a ligature, a circumstance that escaped notice by the High Court and, thus, required an explanation from the accused with whom the deceased spent her last moments under the same roof---Supreme Court granted leave to consider the said contention.
