HASSAN NAWAZ VS ATTA MUHAMMAD (DECEASED) O. XVIII, Rr. 8, 15, 16(3), 17 & O. XXVI, Rr. 1, 7---Memorandum where evidence not taken down in writing by a Judge---Scope---Evidence recorded through Local Commission appointed by consent of both parties---Rule 8 of O. XVIII, C.P.C. was not applicable in cases where the evidence was recorded, under the orders of the Court through a Commission---Trial Court/Judge may take into consideration the evidence or memorandum of evidence, as the case may be, either recorded by the court itself, the predecessor Judge, or through Commission---Once such report of the Commissioner, along with the evidence so recorded was taken on record, it formed part of the judicial record and was to be read at any hearing of the suit and for making any order or pronouncement of judgment.
