BAD SHAH JAMIL VS MUHAMMAD JANBAZ KHAN Ss. 302(b), 324 & 34---Qatl-i-amd, attempt to commit qatl-i-amd, common intention---Appreciation of evidence---Benefit of doubt---Recovery of crime empties from the spot---Reliance---Scope---Accused was charged for committing murder of the cousin of complainant, whereas the co-accused made firing upon the complainant, but he escaped unhurt---Empties collected from the spot were not sent to the Forensic Science Laboratory with the request as to whether those empties especially, the three recovered from the spot were fired from one or different weapons---Accused was arrested but at the time of arrest nothing incriminating was recovered from his possession so much so the weapon of offence---Circumstances established that the prosecution had failed to prove its case against the accused---Appeal against conviction was allowed, in circumstances.
