MUHEEB ULLAH VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Benefit of doubt---Motive was not proved---Scope---Accused was charged for committing murder of his own brother by firing---Complainant had alleged the domestic quarrels as the motive behind the occurrence but prosecution had not produced any evidence in support of the said motive---No doubt, absence or weakness of motive by itself was not a proof of innocence of an accused, however, that shortcoming of the case in addition to other evidence of doubtful nature brought on the record was sufficient to create further suspicion in the story of prosecution---Circumstances established that the prosecution had failed to prove its case against the accused beyond shadow of reasonable doubt---Appeal against conviction was allowed, in circumstances.
