MISAL KHAN VS AMJAD KHAN Ss. 324, 334 & 34---attempt to commit qatl-i-amd, itlaf-i-udw, common intention---appreciation of evidence---Benefit of doubt---Motive was not proved---Scope---Prosecution case was that the accused made firing upon the complainant, as a result of which, he was hit and fell down---Motive for the offence was stated to be a dispute over construction of path---Record showed that the Investigating Officer neither collected documentary evidence nor recorded the statement of any one from the locality in that respect and when so, the motive went unproved---appeal against conviction was allowed, in circumstances.
