FATEH KHAN VS State S. 497---Penal Code (XLV of 1860), Ss. 324 & 34---Attempt to commit qatl-i-amd and common intention---Bail, grant of---Scope---Accused along with his brother while present on the rooftop of their kotha allegedly threatened complainant and his brother to stop, and made indiscriminately firing at them---Place from where the accused had fired was at a distance of 220 paces which could be rounded up as 400 feet---Complainant had yet to establish that whether from such a long distance the voice if raised could be heard and as to whether the accused could reasonably be seen and identified from such a long distance that too inside the covered bulwark---Investigating Officer had not recovered crime empties from the spot where the accused were shown to be present at the time of firing---Petition for grant of bail was allowed, in circumstances.
