FAZAL DAYAN VS State art. 46---Dying declaration---Scope---Dying declaration is a valuable piece of evidence made by a person in the extremity when he/she is at the point of death and every hope of survival has vanished---Since the deponent cannot be subjected to cross-examination, therefore, close scrutiny of dying declaration was to be made so as to ascertain its reliability---Before taking such statement into consideration, the court, in order to satisfy itself regarding fitness of mind of the deceased then injured, shall look into the medical opinion.
