AKBAR KHAN VS State S. 302 (b)---Qatl-i-amd---Appreciation of evidence---Benefit of doubt---Recovery of dead bodies from the house of accused---Scope---Accused was charged for committing murder of his mother and her paramour due to existence of their illicit relations, he had himself lodged the FIR---Record showed that the dead bodies were recovered from the house of the accused, however, it was important that the house had not been in exclusive possession of the accused---Prosecution evidence had stated that, father and other brother of accused had also been living in said house and his uncle had also been living nearby---Said house was not having a boundary wall around it, according to site plan---Criminal liability, in circumstances, could not be fixed on the accused, just for the reason that he had been living in the house---Appeal against conviction was allowed, in circumstances.
