ZAFAR SAEED alias ZAFAR KHAN VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Benefit of doubt---Delay of about two hours in lodging the FIR---Effect---Accused was charged for committing murder of the brother of the complainant by firing---Motive for the offence alleged by the complainant was dispute over women folk---Record showed that the incident was reported to the local police after a delay of 2 hours---Distance between the spot and Police Station was given as 7/8 kilometres---Complainant explained the delay that initially it took 30-minutes to arrange a vehicle and thereafter the dead-body was taken to the hospital, where they spent 20/40 minutes as the deceased was examined by the doctor---Complainant further stated that the police was not present in the hospital, so they were advised to shift the deceased to the Police Station, which they did accordingly---Prosecution failed to convince the Court that time was not used for consultation and deliberations---Appeal against conviction was allowed, in circumstances.
