ZAFAR SAEED alias ZAFAR KHAN VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Benefit of doubt---Delay in sending the crime empties for analysis---Scope---Accused was charged for committing murder of the brother of the complainant by firing---Record showed that the recovered empties were sent to Forensic Science Laboratory on 09.02.2017, whereas those were received on 15.02.2017---Nothing was brought on record that where those empties were lying in the intervening period---Neither the Moharrir of the Police Station was examined nor abstract from register number 19 was collected---Witness, who was the person to have taken the empties to the Forensic Science Laboratory, appeared before the court and stated in respect of other facts, but remained silent of his taking the empties to the Laboratory for chemical examination---Silence of said witness in that respect destroyed the evidentiary value of the empties and its report---Appeal against conviction was allowed, in circumstances.
