BILAL AHMAD VS State Ss.302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Benefit of doubt---Delay of sixteen hours in lodging the FIR---Scope---Accused was charged for committing murder of the deceased by inflicting churri blows---Occurrence took place at about Maghrib prayer time and matter was informed to police after about sixteen hours---No explanation whatsoever had been given in FIR for that delay---Such unexplained delay in lodging the FIR was fatal to the prosecution case---Circumstances established that the prosecution had failed to prove its case beyond shadow of doubt---Appeal against conviction was allowed, in circumstances.
