IMTIAZ AHMAD VS State Ss.302(b), 324 & 34---Qatl-i-amd, attempt to commit qatl-i-amd, common intention---Appreciation of evidence---Contradictions in the statements of witnesses---Accused was charged for committing murder of the complainant's son and injuring another person by firing---Perusal of record revealed that although witnesses had nominated the accused persons in their statements under S.161, Cr.P.C. but statement of one witness, as per his own version, was recorded on 17.11.2011, while as per the version of Investigating Officer statements of all the witnesses were recorded on the same date i.e. 11.11.2011---Said aspect dented the credibility of statements of witnesses and from recording of those statements after the supplementary statement of complainant, it could easily be inferred that statements of witnesses were recorded after due deliberation and that nomination of accused and other co-accused was a result of forethought---Circumstances established that the prosecution had failed to prove its case against the accused beyond reasonable doubt---Appeal was allowed and accused was acquitted by setting aside convictions and sentences recorded by the Trial Court.
