MUHAMMAD NABI alias NABIKHO VS State S. 302(b)--- Qatl-i-amd---Appreciation of evidence---Benefit of doubt---Crime weapon was recovered on the disclosure of accused---Reliance---Scope---Accused was charged for committing murder of the brother of complainant by firing---Record showed that the Investigating Officer had recorded the disclosure of the accused and also got recovered the crime weapon allegedly used in the crime on the pointation of accused beneath of a stone from the graveyard---Statements of eye-witnesses were silent rather they deposed that the accused escaped to barracks---Contents of such disclosure were not corroborating the other pieces of evidence rather contrary to the same, hence the disclosure of the accused as well as the recovery of crime weapon also not strengthened the case of prosecution---Circumstances established that the prosecution had failed to prove its case against the accused beyond shadow of doubt---Appeal against conviction was allowed, in circumstances.
