TAJ MUHAMMAD VS State S. 302(b)--- Qatl-i-amd---Appreciation of evidence---Benefit of doubt---Motive was not proved---Scope---Accused was charged for committing murder of the son of complainant by firing---Motive alleged was that the accused had borrowed an amount of Rs. 50,000/- from complainant and on demand for its return, accused was insulted by deceased---Prosecution was under heavy burden to prove that at what date, time and place and in what manners the accused had borrowed the amount of Rs.50000/- from complainant party---Said duty was not discharged, so without any further discussion it was held that motive was not proved in the case---Circumstances established that the prosecution had failed to prove its case against the accused beyond any shadow of doubt---Appeal against conviction was allowed, in circumstances.
