MUHAMMAD SAJID VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Benefit of doubt---Delay of about nine hours and forty five minutes in lodging the FIR---Scope---Accused was charged that he along with co-accused committed murder of the daughter of complainant---Record showed that the occurrence in the case allegedly took place at 04:00 a.m. (morning) whereas the matter was reported to the police on the same day at 01:45 p.m. (noon)---Distance between police station and the place of occurrence was eleven miles---Delay of about nine hours and forty five minutes in reporting the crime to the police without any plausible explanation---Complainant and witnesses did not utter even a single word about the said delay---Inordinate delay in setting the machinery of law in motion spoke volumes against the veracity of prosecution version---Circumstances established that the prosecution had failed to prove its case against the accused beyond any shadow of doubt---Appeal against conviction was allowed, in circumstances.
