SHAHBAZ alias GILLU VS State Ss. 302(b), 148 & 149---Qatl-i-amd, rioting armed with deadly weapon, unlawful assembly---Appreciation of evidence---Benefit of doubt---Source of light not taken into possession---Scope---Accused were charged that they in furtherance of their common object while armed with deadly weapon committed murder of the father of the complainant by firing---Although it had been narrated by eye-witnesses that they had seen the accused in the light of bulb but the Investigating Officer had not taken into possession any source of light---Prosecution had failed to establish the fact of availability of source of light and in absence of its inability to do so, the existence of such a light source could not be presumed---Circumstances established that the prosecution had failed to prove its case against the accused beyond shadow of doubt--- Appeal against conviction was allowed, in circumstances.
