SHAHBAZ alias GILLU VS State Ss. 302(b), 148 & 149---Qatl-i-amd, rioting armed with deadly weapon, unlawful assembly---Appreciation of evidence---Benefit of doubt---Recovery of weapon of offence on the pointation of accused---Reliance---Scope---Accused were charged that they in furtherance of their common object while armed with deadly weapon committed murder of the father of the complainant by firing---Record showed that the recovery of Kalashnikov at the pointation of accused was of no avail to the prosecution because there was no report of Forensic Science Agency with respect to said Kalashnikov---Recovery of weapon of offence was only a corroborative piece of evidence, and conviction could not be based merely on the corroborative piece of evidence---Prosecution had failed to connect the neck of the accused with the crime in any manner whatsoever---Appeal against conviction was allowed, in circumstances.
