JAWAAD ALI VS State S. 9(c)---Qanun-e-Shahadat (10 of 1984), Art. 129(g)---Possession of narcotics--- Appreciation of evidence--- Benefit of doubt---Withholding material evidence---Scope---Prosecution case was that 2010 grams charas was recovered from the vehicle of accused and 2110 grams charas was recovered from the vehicle of co-accused---Head Constable who was a witness to the memo of arrest, search and seizure and was also present at the time of sealing of the parcels of alleged charas was dropped as a witness by the prosecution---Non-examining of said witness was fatal to the prosecution case---Circumstances established that the prosecution had failed to prove its case against the accused beyond any shadow of doubt---Appeal against conviction was allowed, in circumstances.
