RIAZ HUSSAIN VS State Ss. 382-a, 426 & Chapt. XXVIII---appeal, filing of---Procedure---Convict either can file appeal against his conviction and sentence being on bail under S. 382-a, Cr.P.C or he can seek his release on bail under S. 426, Cr.P.C. during pendency of his appeal, while under custody---Unless convict is either on bail by way of postponement of his sentence in terms of S. 382-a, Cr.P.C. or he is confined in terms of the provisions of Chapt. XXVIII, Cr.P.C. (of execution), no appeal against judgment of conviction can be entertained.
