MUHAMMAD ASLAM VS State Ss. 302(b) & 324---Qatl-i-amd, attempt to commit qatl-i-amd---Appreciation of evidence--- Quantum of sentence--- Mitigating circumstances---Scope---Accused was charged for committing murder of the deceased by inflicting churri blows and also injuring his wife---Mitigating circumstances were present i.e. the motive of the incident remained shrouded in mystery, also been conceded by prosecution---If no motive had been proved by the prosecution, that was a ground which the court might use in exercising its sentencing discretion to reduce the sentence of death to life imprisonment---In such circumstances, the sentence was reduced from death penalty to life imprisonment---Appeal against conviction was dismissed with said modification in sentence.
