ALAM KHAN VS State Ss. 302(b), 392 & 34---Qatl-i-amd, robbery, common intention---Appreciation of evidence---Benefit of doubt---Recovery of currency notes from accused persons---Scope---Accused were charged for murdering the uncle of complainant by firing while committing robbery---Prosecution had also stressed upon another piece of evidence which was recovery of currency notes from the accused persons---Said recovery of currency notes was not helpful to the prosecution case because no number of currency notes had been given in the FIR---Subsequently after the recovery of alleged currency notes no identification of currency notes was held---Even in the recovery memos, no number of currency notes had been mentioned, for the reason those recovery memos had no evidentiary worth in the eye of law---Even otherwise, currency notes were easily available from the market and could easily be planted---Circumstances established that the prosecution had failed to prove its case against the accused persons beyond any shadow of doubt---Appeal against conviction was allowed, in circumstances.
