SAMAR ABBAS VS State S. 302(b)--- Qatl-i-amd---Appreciation of evidence---Benefit of doubt---Recovery of weapon of offence---Reliance---Scope---Accused was charged for committing murder of his wife/daughter of complainant by firing---Record showed that .30 bore pistol was recovered at the instance of accused, however, the said recovery was immaterial because the accused was arrested on 02.08.2016 whereas, as per report of Forensic Science Agency, the crime empties were received in the said office on 04.08.2016 i.e. after the arrest of the accused---If the crime empty was sent to the Forensic Science Laboratory after the arrest of the accused or together with the crime weapon, the positive report of the said Laboratory lost its evidentiary value---Circumstances established that the prosecution could not prove its case against the accused beyond any shadow of doubt---Appeal against conviction was allowed, in circumstances.
