AJDAR ALI VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Accused was charged for committing murder of the father of complainant---Record showed that the complainant was the only eye-witness of the occurrence who at the relevant time was aged about 18/19 years old---Said witness was a natural witness and his presence along with his father at the relevant time inspired confidence---Not only promptitude in registration of the FIR but the absence of motive to falsely implicate the present accused belied the impression regarding the non-presence of that witness at the time of occurrence, who appeared before the Court and reaffirmed the mode and manner of occurrence which he had narrated in the FIR---Even at the time of recording his statement before the Court he did not disclose the motive for the occurrence which indeed was known to the deceased and the accused as explained in the confessional statement of the accused---Medical evidence was in line with the prosecution case followed by the confession of the accused---Circumstances established that the prosecution had proved its case against the accused without and shadow of doubt---Appeal was dismissed accordingly.
