WALEED SHAH VS State Ss. 302(b), 506(ii), 148 & 149---Qatl-i-amd, criminal intimidation, rioting armed with deadly weapon, unlawful assembly---Appreciation of evidence---Benefit of doubt---Accused was charged that he along with co-accused made firing upon the brother of complainant, who was hit and died---Record reflected that during investigation co-accused persons were found innocent by the Investigating Agency and their names were placed in column No.2 of the challan, thus, the complainant had implicated as many persons as possible from the accused side---Net was thrown wide deliberately in order to ensure that no male member from the accused side was spared to pursue the criminal case---Trial Court while agreeing with the investigation had acquitted said co-accused persons vide the impugned judgment by disbelieving version of prosecution---No acquittal appeal was filed to challenge the said acquittal---In view thereof, it appeared that the Trial Court had not evaluated all those factors, discrepancies and the evidence in true perspective and thus reached to an erroneous conclusion by holding the accused guilty of the offence and awarded sentence to him---Appeal against conviction was allowed, in circumstances.
