BADAR ZAMAN VS State S. 302(b)---Qanun-e-Shahadat (10 of 1984), Art. 46---Qatl-i-amd---Appreciation of evidence---Benefit of doubt---Dying declaration---Scope---Accused was charged for committing murder of the wife of the complainant---Record showed that dying declaration of the deceased recorded by the Investigating Officer was exhibited in evidence, which reflected a note of doctor showing that victim was able to give statement---However, the said witness, who put the note, had not been examined by the prosecution---No evidence other than such note which showed that the deceased came into sense---Another witness deposed that when he arrived at place of incident he had seen that the deceased then injured was semi-conscious---Circumstances established that prosecution had failed to prove its case against the accused beyond any reasonable doubt---Appeal against conviction was allowed, in circumstances.
