ASLAM SOLANGI VS State Ss. 302(b), 148, 149 & 506---Qatl-i-amd, rioting armed with deadly weapon, unlawful assembly, criminal intimidation---Appreciation of evidence---Benefit of doubt---Unnatural conduct of witnesses---Scope---Accused were charged for committing murder of the father of the complainant---All the three eye-witnesses admitted in their evidence that there was distance of two and half Kilometres in between floor machine wherefrom the deceased was dragged by the accused persons and the Jannat Shakh where deceased was murdered---Complainant and eye-witnesses chased the accused persons for the same distance but they did not take any efforts to save the deceased or send back one of them to their village for informing co-villagers about the incident that might have saved the deceased as the distance which as per prosecution case was not so long and accused persons also travelled by foot---Conduct of prosecution witnesses to remain silent till two and half kilometres was also doubtful---Investigating Officer during the cross-examination also admitted that there were two villages in the way from the floor machine to Jannat Shakh but unfortunately the complainant party not called a single person from both the villages to save the life of the deceased or to inform any of the villager about the incident---Said fact also diverted the mind that the incident as narrated by the complainant party did not happen but the story was managed and none of them saw the incident---Circumstances established that the prosecution had failed to prove its case against the accused beyond any shadow of doubt---Appeal against conviction was allowed, in circumstances.
