ALI HASSAN VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Sentence reduction in---Motive was not proved---Scope---Accused was charged for committing murder by firing a single shot---Firing one shot from a pistol which resulted in the death of deceased, could only lead to the inference that the petitioner had intention to kill the deceased---The medical evidence and the statement of the witnesses proved that a single shot was fired at the deceased which turned out to be fatal---The court while convicting the accused must also examine whether the accused had a motive to kill the deceased and if the prosecution failed to prove the motive, the same would be a valid consideration for reduction of sentence---In the present case, the prosecution had failed to prove the motive, thus, the death sentence was reduced to imprisonment for life.
