ABDUL RAHIM VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Sentence, reduction in---Weapon of offence and crime empties were recovered---Scope---Prosecution case was that the sister of complainant had been murdered by the brother of husband of deceased by firing---Investigating Officer recovered two empty cartridges from the roof of the house of accused wherefrom he fired upon the deceased---Other supportive evidence produced by the prosecution was recovery of said repeater from the accused---To prove the recovery, prosecution examined a witness who deposed that SHO took the accused from lockup in his presence for interrogation---During interrogation accused agreed to provide crime weapon---Accused then took the police to the place where he had concealed the same---Circumstances established that the prosecution had proved its case against the accused, however motive of occurrence had remained shrouded in mystery---Such factor had put the Court to caution in the matter of the sentence of death of the accused---Sentence of death of the accused was reduced to imprisonment for life, in circumstances---Appeal against conviction was dismissed with modification in sentence.
