GUL HASSAN alias GULAN VS State S. 302(b)--- Qatl-i-amd---Appreciation of evidence---Benefit of doubt---Last seen evidence---Accused was charged for committing murder of two persons by dagger blows to grab their money---Record showed that deceased was living separately with his second wife deceased and adopted daughter---Complainant and two witnesses went to him with rupees two lac to make purchase of plot, which they allegedly gave to him in presence of the accused---Subsequently, when said persons came back to the house of the deceased daughter was crying by saying that her parents had been killed by the accused for money---Said persons narrated the incident to police---Apparently, the complainant and witnesses had not seen the actual incident with their eyes---Evidence of said witnesses, if any, was only to the extent that they had seen the accused lastly in the company of the deceased, when they delivered money to the deceased, which on face of it, was appeared to be weak---Circumstances established that the prosecution had not been able to prove its case against the appellant beyond shadow of doubt---Appeal was allowed and accused was acquitted.
