MUHAMMAD TARIQ VS State Ss. 302(b), 109, 148 & 149---Qatl-i-amd, abetment, rioting armed with deadly weapon, unlawful assembly---Appreciation of evidence---Benefit of doubt---Dishonest improvements in the statements of witnesses---Scope---Accused were charged that they along with co-accused while armed with deadly weapons committed murder of the maternal nephew of the complainant---Record showed that accused caused an injury on the right thigh of deceased while co-accused caused more than one injury with repeated fire shots that hit on right thigh of deceased---Similarly, other co-accused shot fire hitting pellets on right thigh of deceased---However, both the witnesses had tried to bring the ocular account in line with the medical evidence while making improvements in the most relevant part of the occurrence which had made the credibility of their depositions seriously doubtful and discredited the same---Besides that, it was also worth mentioning here that deceased, as per statement of Medical Officer, sustained only a single firearm entry wound on his right thigh while other two injuries available on his right thigh were exit wounds---First Information Report showed three persons/accused had separately caused entry wound available on the person of deceased---Actually, who caused said injury out of the three accused was a question, that, in the circumstances of present case, remained unanswered, hence, benefit of the doubt was to be extended to the accused---Circumstances established that the prosecution failed to prove its case against the accuse beyond the shadow of reasonable doubt---Appeal against conviction was allowed, in circumstances.
