PROVINCE OF PUNJAB VS SAJIDA ZAHEER Directory or mandatory provision, determination of---Scope---Integral test while determining whether a provision in a statute is directory or mandatory in nature is to ascertain the legislative intent and purpose is to be achieved by the application of the provision of law rather than literal approach---Court would prefer an interpretation which advances the object of the enactment over that which defeats it---Intention of legislature must govern, which is to be ascertained not only from the phraseology of the provision but also by considering its nature, the object and the consequences which would follow from construing it in one way or the other.
