AZIZULLAH BHAYO VS CHIEF EXECUTIVE OFFICER, QESCO, QUETTA S.3---Dismissal of suit, etc., instituted after period of limitation---Scope---Section 3 of Limitation Act, 1908, is mandatory in nature according to which the suit filed beyond limitation shall be dismissed even though the limitation has not been taken in defence---Law does not leave the matter of limitation to the parties---Law imposes the duty upon the Court and it is obligatory upon the Court to first decide the question of limitation---Where the Court comes to the conclusion that the suit/appeal has been filed beyond the period of limitation, it is to dismiss the suit/appeal without touching merit.
