KHALID MAHMOOD VS SECRETARY, INFORMATION AND BROADCASTING Successive supersessions---Mala fide, plea of---Proof---Petitioner was successively superseded for third time and not promoted to next post---Petitioner attributed unfairness to Selection Committee for not providing him opportunity of hearing by the Committee and he claimed that he should have been confronted with material that had adversely effected him---Validity---Nothing was brought on record to attribute bad faith or mala fides to Members of Selection Committee---First two supersessions remained unchallenged by petitioner while last one had been for the same reason i.e. lack of required number of marks---Representation of petitioner was also responded in terms that his successive supersessions had been due to lack of required number of marks, required under the rules--- Unfairness retained no worth when petitioner himself opted not to contest his two successive supersessions---Action based on mala fide of law or mala fide of fact could be challenged while terms and conditions of service embraced bona fide discharge of public duties by respective authorities---High Court while exercising jurisdiction in terms of Art.199 of the Constitution was not vested with any authority to compel competent authority to promote petitioner as it would amount to cause interference and hamper functioning of departmental authorities---Constitutional petition was dismissed, in circumstances.
