MUJTABA AHMED KHAN VS INSPECTOR GENERAL OF POLICE, AZAD GOVERNMENT OF THE STATE OF JAMMU AND KASHMIR Regularization of service---Retrospective effect---Scope---Petitioners were initially appointed on contract basis and later on the competent authority issued a notification in the year 2015 whereby the project, in which the petitioners were employed, was brought on normal budget meaning thereby that the services of petitioners were converted to regular employees---Department, however, did not implement the notification which prompted the petitioners to approach the High Court through a writ petition wherein a specific direction was given to the department to implement the notification---Petitioners were ultimately adjusted in regular service but with effect from 2018---Petitioners, through the present petition, sought calculation of their salary and other emoluments with effect from the year 2015---Validity---Referred notification for its all practical purpose was beneficial to the extent of rights of the petitioners, hence, the petitioners were entitled to receive benefits of notification from the date of issuance of the same---Writ petition was accepted.
