MAZHAR ALI VS FEDERATION OF PAKISTAN through Secretary, Water and Power Pakistan Secretariat, Islamabad art.199---Constitutional petition---Civil service---Judicial review---Functional test of employer company/institution---Scope---Respondent, an Electric Supply Company, was a State Enterprise---Government owned the majority of shares---Chief Executive of the Company was nominee of Government of Pakistan and was delegated with such powers by the Board of Directors as were necessary to effectively conduct the business of the Company---Respondent could ordinarily be regarded as a 'person' performing functions in connection with the affairs of Federation under art.199(1)(a)(ii) read with art.199(5) of the Constitution, thus, the High Court had an entry point to exercise judicial powers in the subject affairs of the respondent under the Constitution.
