Dr. KHURSHID IQBAL VS FEDERATION OF PAKISTAN through Secretary, Ministry of Law and Justice, Islamabad arts. 175-a(8), 175-a(12) & 199---additional Judges of Peshawar High Court, appointment of---Parliamentary Committee, powers of---Scope--- Parliamentary Committee not confirming for appointment candidates recommended by the Judicial Commission---Held, that Parliamentary Committee ('the Committee') could not assume jurisdiction and powers of the Commission, or act as an appellate forum to the Commission---lf from the material produced before it, the Committee by a three-fourth majority of its total membership reached a conclusion that a particular nominee had no moral principles, was unscrupulous or his past was such that rendered him unfit then of course the Committee would be well within its competence and justified in not confirming the recommendations of the Commission---But so far as professional caliber, competency, judicial skills and inter-se seniority positions of the members of the district judiciary recommended by the Commission for their appointment as additional Judges of High Court are concerned, the same on no count were areas for the Committee to ponder over---Constitutional petitions was allowed.
