SAAD SUMAIR VS NATIONAL ACCOUNTABILITY BUREAU (NAB) S. 54---Constitution of Pakistan, Art. 199---When police may arrest without warrant---Judicial review of a person's arrest---Scope---State must not exercise its police powers to arrest a citizen merely because a report or complaint has been filed against him which is under investigation---Exercise of the power of arrest must neither be mechanical nor arbitrary, and if it is motivated by ulterior motives or collateral purpose not conceived by law and not in the interest of justice, such exercise of the State's police powers shall be deemed mala fide and is liable to be judicially reviewed.
