KAZIM ALI VS ISHAQ ALI S. 3---Dismissal of suit, etc., instituted after period of limitation---Scope---Provisions of S. 3 of Limitation Act, 1908, are mandatory in nature---Every suit instituted after the period of limitation shall, subject to the provisions of Ss.4 & 25 of the Limitation Act, 1908, be dismissed although limitation has not been set up as a defence.
