UMER ZAHID MALIK VS FEDERATION OF PAKISTAN, through Secretary Ministry of Finance, Islamabad Ss.168 & 2(s)--Seizure of things liable to confiscation---Smuggling---Scope---While initial responsibility lies with the person tempering with a vehicle, however, a subsequent purchaser ought to take due care towards ensuring compliance with the requirements of law; in the absence whereof he cannot claim to a bona fide purchaser---Purchaser's remedy lies in a claim of damages against the person from whom he purchased the vehicle---Smuggled vehicle with an apparent tampered chassis frame merits outright confiscation.
